
A court in Amsterdam has rejected a collective suit brought by the non-profit The Privacy Collective (TPC) against Oracle and Salesforce, declaring the claim inadmissible. TPC said it had signed up 75,000 supporters online for the suit.
The court questioned TPC's system of signing up claimants, saying it was not representative of a sufficiently large group. Participants had to click a thumb's up to 'like' the proposal online. The information about the planned lawsuit also was too vague, the court said.
Furthermore, it was not shown that people who supported the case also were directly affected. Nor were any of their contact details registered, so TPC could manage relations with the group, something required by law.
The lawsuit was launched in August 2020, and TPC was claiming EUR 5 billion in damages from the two software companies. The group said each internet user was owed EUR 100 for the data breach discovered at Oracle in 2020.
